You cross into "major source" around a 100 MW data center
Regulators talk in tons per year. You think in megawatts.
The major-source line is 100 tons/year of a pollutant like NOx, 250 under PSD, and 10/25 for hazardous air pollutants (EPA). A Tier 2 backup diesel emits about 5.5 grams of NOx per kWh. Capped at the standard 100 test hours a year, that is roughly 0.6 tons per MW of generator (Better Data Center Project; 40 CFR 63.6640(f)).
The math:
- The 100-ton line hits around 165 MW of generators, roughly a 100 MW data center once you add N+1 redundancy.
- Under that, you stay a minor source. Over it, you cap hours harder, move to Tier 4 engines, or take full major-source review.
- The real lever is hours, not size. Run generators for bridge or peak power and a 20 MW site clears 100 tons on its own.

You build at your own risk, and the rules can still be struck down
The tailwind is real, deliberate, and reversible. Three things to hold onto:
- Pre-permit building is at your own risk. A denied or modified permit can force you to redesign or tear out what you already built (K&L Gates).
- The rules can die. Courts have struck down EPA rules before, and environmental groups will sue. A vacated rule takes your schedule and capital plan with it (Data Center Knowledge).
- Zoning and grid still bite. The federal air-permit changes touch neither, and that is where projects are stalling now.
Move first without becoming the operator whose corner-cutting hands critics the case for the next moratorium. A clean permitting posture is not a brake. It is how you keep the runway open.
